What is new?
The changes introduced by the Act to Promote the Use of Video Conferencing Technology in Civil and Specialized Courts (BGBl. I 2024, No. 237) have been taken into account in the commentary.
The provision on electronic files (section 298 a ZPO) takes into account the amendment by the Act on the Further Digitization of the Judiciary of 12.07.2024 (BGBl. I No. 234), as well as the electronic file management that has been mandatory since 1.1.2026.
In particular, the new Section 273a of the German Code of Civil Procedure (ZPO) on the confidentiality of business secrets, which was introduced by the Act to Strengthen the Judiciary (BGBl. 2024 I, No. 302) with effect from April 1, 2025, was commented on for the first time.
Section 305b ZPO, inserted by the Act Implementing the Conversion Directive (BGBl. 2023 I, No. 51) with effect from March 1, 2023, is also included in the new edition.
